If I play a song, I'm doing it under fair use, on the grounds that we're analyzing it. And I always check with the guest to make sure it's OK. Clips the same. That said, I don't get releases, mostly because I'm not in the same place as the people, and I would just comply with a cease and desist.
Secondly, I'd presume so (say, burning a cd of a show for a friend), but I can't cite any specific instances.
And for anyone who might be interested -- I'm very flexible on the no-derivs issue, if you want to make a derivative work (say... an animation of an interview or something), I'm probably happy to give you permission.
